1. Acceptance of Terms

By purchasing a Dargo device, accessing our website, or using our services, you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use our products or services.

These terms constitute a legally binding agreement between you and Dargo. Please read them carefully before making a purchase or using our services.

2. Service Description

Dargo provides a comprehensive solution for hosting websites, applications, and bots from your home or office. Our service consists of two essential components:

2.1 Hardware Device

We sell physical hardware devices that can be purchased through our ecommerce store. These devices are designed to function as residential web servers, serving as a replacement for traditional cloud web servers, VPS (Virtual Private Server), or web hosting services.

2.2 Traffic Routing Service

We provide a traffic routing service that directs internet traffic to your Dargo device, enabling it to serve content to the public internet. This service operates on a pay-as-you-go pricing model with the following terms:

  • Free monthly traffic allowance for all users
  • No charges if your usage remains within the free limit
  • Usage-based billing only for traffic exceeding the free monthly allowance
  • Real-time traffic monitoring available through your account dashboard

2.3 Service Dependency

IMPORTANT: The Dargo hardware device is heavily dependent on our web services and traffic routing infrastructure. The device cannot function properly without our web service. By purchasing and using a Dargo device, you acknowledge and accept this dependency.

3. Account Registration and Responsibilities

To use Dargo services, you must create an account through our web portal. You are responsible for:

  • Providing accurate and complete information during registration
  • Maintaining the security and confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your device is used in compliance with these terms

4. Acceptable Use Policy

You agree to use Dargo services only for lawful purposes and in accordance with these Terms of Use. You are solely responsible for all content hosted on your Dargo device.

4.1 Strictly Prohibited Activities

The following activities are strictly prohibited and will result in immediate service termination:

  • Child Sexual Abuse Material (CSAM): Zero-tolerance policy with immediate termination and reporting to law enforcement
  • Fraud and Scams: Any deceptive practices designed to defraud individuals or entities
  • Phishing: Attempts to obtain sensitive information through deceptive means
  • Hacking and Cyber-Attacks: Unauthorized access to systems, networks, or data
  • Security Abuse: Activities that compromise network or system security
  • Email and Messaging Abuse: Spam, unsolicited bulk email, or malicious messages
  • Copyright Infringement: Hosting or distributing copyrighted material without authorization
  • Intellectual Property Violations: Infringement of trademarks, patents, or other IP rights
  • Fraudulent or Deceptive Services: Operating services that mislead or deceive users
  • Illegal Gambling: Operating unlicensed or illegal gambling websites or services
  • Malware Distribution: Hosting or distributing viruses, trojans, or other malicious software
  • Illegal Content: Any content that violates federal, state, or local laws

4.2 Additional Restrictions

You may not:

  • Use the service to harm, threaten, or harass others
  • Violate any applicable laws or regulations
  • Interfere with or disrupt our services or servers
  • Attempt to bypass any security or authentication measures
  • Use the service to collect personal information without consent
  • Resell or redistribute our services without authorization

5. Service Termination and Consequences

5.1 Termination for Violations

CRITICAL NOTICE: If you violate these Terms of Use, we reserve the right to immediately terminate your access to our traffic routing service without prior notice. Upon service termination:

  • Your Dargo device will cease to function as a web server
  • All traffic routing to your device will be stopped
  • You will lose access to our web portal and management tools
  • Your device will not be able to serve content to the public internet

5.2 Returns and Service Termination

IMPORTANT CLARIFICATION: Your ability to return a device is governed solely by our Return & Refund Policy. Service termination does NOT automatically prevent you from returning a device. Specifically:

  • Within the return window (30 days) and meeting return conditions: You CAN return the device for a refund, even if service was terminated for policy violations
  • Outside the return window or not meeting return conditions: You CANNOT return the device, regardless of whether it is functional or whether service was terminated
  • Service termination is NOT a special exception to the return policy timeframe or conditions
  • Once outside the return window, there is no recourse if your device is non-functional due to service termination
  • You acknowledge that the device's functionality is dependent on continued access to our services

In summary: The return policy decides if you can return, not service status. If you're within 30 days and the device meets return conditions, you can return it. If you're past 30 days, you cannot return it, even if the device doesn't work due to service termination.

5.3 Warranty Exclusions

Our product warranty does NOT cover:

  • Device malfunction or non-functionality resulting from service termination
  • Loss of service due to violations of these Terms of Use
  • Any damages or losses resulting from your inability to use the device after service termination

The warranty covers only hardware defects under normal, compliant use of the device and service.

5.4 Your Acknowledgment

By purchasing and using a Dargo device, you explicitly acknowledge and agree that:

  • The device requires our web service to function
  • We may terminate service for violations of these terms
  • Service termination will render the device non-functional
  • Returns are governed solely by the Return & Refund Policy (30-day window), not by service termination status
  • Once outside the return window, service termination is not grounds for refund, return, or warranty claim
  • You are solely responsible for complying with all terms and policies

6. Billing and Payment

6.1 Hardware Purchase

Hardware devices are purchased through our ecommerce store. All prices are listed in USD and are subject to applicable taxes. Payment is required at the time of purchase.

6.2 Traffic Routing Service

Our traffic routing service operates on a pay-as-you-go model:

  • You receive a free monthly traffic allowance
  • No charges apply if you stay within the free limit
  • Traffic exceeding the free limit is billed based on usage
  • Billing occurs monthly for the previous month's excess usage
  • You are responsible for monitoring your usage through the dashboard

6.3 Payment Methods

We accept payment through Shopify Payment, PayPal, and Stripe. You must provide accurate billing information and authorize us to charge your payment method for applicable fees.

6.4 Late Payment and Non-Payment

Failure to pay outstanding balances may result in service suspension or termination. We reserve the right to charge interest on overdue amounts and pursue collection of unpaid fees.

7. Return Policy

Our return policy for hardware devices is subject to specific terms and conditions:

  • Returns must be initiated within the specified return window from date of purchase
  • Devices must be in original condition with all packaging and accessories
  • Return shipping costs may apply
  • Refunds are processed to the original payment method
  • Service termination due to policy violations does NOT qualify for return or refund

8. Intellectual Property

All content, trademarks, logos, and intellectual property on our website and services remain the property of Dargo or our licensors. You may not use our intellectual property without prior written permission.

Third-party applications available through Dargo App Store are subject to their respective licenses and terms of use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Dargo is not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid for the device
  • We are not responsible for content hosted on your device
  • We are not liable for service interruptions, data loss, or security breaches
  • We are not responsible for damages resulting from service termination due to policy violations

10. Disclaimer of Warranties

SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties regarding uptime, reliability, or performance
  • Warranties regarding the security of your hosted content
  • Warranties regarding third-party applications or services

11. Indemnification

You agree to indemnify, defend, and hold harmless Dargo, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our services or devices
  • Content you host on your device
  • Your violation of these Terms of Use
  • Your violation of any laws or third-party rights

12. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. Please review our Privacy Policy to understand our data practices.

13. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to our website. We may notify you of material changes via email, but it is your responsibility to review the terms periodically.

Continued use of our services after changes constitutes acceptance of the modified terms.

14. Governing Law and Disputes

These Terms of Use shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration, except where prohibited by law.

15. Severability

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
